Terms of Service

1. Acceptance of Terms

By accessing or using TBK Logs ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

TBK Logs provides engine health analysis and mod path recommendations based on datalog files uploaded by users. The Service analyzes CSV log files from various logging platforms and generates health scores, findings, and upgrade recommendations.

3. Disclaimer

TBK Logs is a diagnostic tool, not a substitute for professional mechanical inspection or tuning advice. Analysis results are based on the data provided and may not capture all conditions affecting your vehicle. Always consult a qualified professional before making modifications or driving decisions based on analysis results.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information and to update it as necessary. TBK Logs reserves the right to suspend or terminate accounts that violate these terms.

5. Data and Privacy

Your uploaded log files and analysis results are stored securely. We do not sell your data to third parties. See our Privacy Policy for details on how we handle your information.

6. Tuner Accounts

Tuner accounts may access client data only when explicitly linked by the client. Tuners agree to use client data solely for the purpose of providing tuning services. Revenue sharing is subject to the Referral Program Terms below.

7. Tuner Referral Program Terms

7.1 Eligibility

The Tuner Referral Program ("the Program") is available exclusively to users with an active, paid Tuner or Tuner Pro subscription ("Participating Tuners"). Free, trial, or Driver accounts are not eligible to participate.

7.2 How It Works

Each Participating Tuner receives a unique tuner code. When a new user ("Referred Driver") creates a TBK Logs account and enters the tuner code during or after registration, that driver is attributed to the Participating Tuner. The Participating Tuner earns a referral commission equal to 70% of the Referred Driver's subscription payments for as long as both of the following conditions are met:

• The Referred Driver maintains an active, paid subscription.
• The Participating Tuner maintains an active, paid Tuner or Tuner Pro subscription.

7.3 Termination of Referral Earnings

Referral commissions cease immediately and permanently if any of the following occur:

• Tuner cancels or downgrades: If the Participating Tuner cancels, downgrades to a non-tuner plan, or allows their Tuner or Tuner Pro subscription to lapse, all referral commissions stop. Commissions do not resume if the tuner re-subscribes. Previously earned commissions that have not yet been paid out will still be honored.
• Referred Driver cancels: If the Referred Driver cancels their subscription, commissions for that driver stop. If the driver later re-subscribes, commissions resume only if the Participating Tuner still holds an active Tuner or Tuner Pro subscription at that time.
• Fraud or abuse: Self-referrals, fake accounts, manipulation of the referral system, or any activity TBK Logs deems fraudulent will result in immediate disqualification from the Program and forfeiture of unpaid commissions.

7.4 Payouts

Referral commissions are calculated monthly and paid out via the payment method on file. TBK Logs reserves the right to set minimum payout thresholds. Payouts are subject to applicable taxes; Participating Tuners are responsible for reporting referral income in accordance with their local tax laws.

7.5 Commission Rate Changes

The current referral commission rate is 70%. TBK Logs reserves the right to modify this rate at any time with 30 days' written notice (via email to the address on file). Rate changes apply to future subscription payments only and do not affect commissions already earned.

7.6 No Employment or Partnership

Participation in the Program does not create an employment, agency, or partnership relationship between the Participating Tuner and TBK Logs. Participating Tuners are independent parties and are not authorized to make representations on behalf of TBK Logs.

7.7 Program Modifications and Termination

TBK Logs reserves the right to modify, suspend, or terminate the Program at any time with 30 days' notice. In the event of termination, commissions earned prior to the termination date will still be paid out in accordance with Section 7.4.

8. Limitation of Liability

TBK Logs shall not be liable for any damages arising from the use of the Service, including but not limited to engine damage, vehicle damage, or personal injury resulting from actions taken based on analysis results.

9. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms.
